REQUIREMENTS FOR REPORT OF BIRTH OF CHILDREN BORN ABROAD OF FILIPINO PARENT/S


 CHECKLIST

Duly accomplished Report of Birth (ROB) Form (all entries may be typewritten. 4 copies) or handwritten (1 copy); Entry in the “Place of Birth” should be in the city or state where the child is born – i.e. SELANGOR, MALAYSIA; KOTA KINABALU, SABAH
Birth certificate must be issued by Jabatan Pendaftaran Negara (JPN) and authenticated by the Ministry of Foreign Affairs, Putrajaya – (4 copies); If Birth Certificate is in Bahasa Malaysia, it must be accompanied by a notarized English translation.
For children who are five (5) years old and above, kindly submit a Negative Birth Record from the Philippine Statistics Authority (PSA);
Marriage Contract of parents (if applicable) - (4 copies); If Marriage Certificate is in Bahasa Malaysia, it must be accompanied by a notarized English translation.

If Marriage Certificate is in a foreign language, it must be accompanied by an English translation from the respective embassy/consulate of the country where the document was issued.
Proof of Identity of the applicant (if applicable) – (4 copies);
Proof of citizenship of parent/s- Parent/s passport /Birth Certificate (4 copies);
Two (2) passport size photo of applicant.
Affidavit of Delayed Registration of Birth, if the child is aged one year old and above (all original) – (4 copies);
Affidavit of Legitimation by Subsequent Marriage, if the child was born after the marriage of the parents – (4 copies)

For those applicants who are born on or after the effectivity of RA 9225, additional requirements for the Report of Birth of children whose parents are not married but opt to use the surname of the father must be accomplished first prior to the Report of Birth application.

If Marriage Certificate is in Bahasa Malaysia, it must be accompanied by a notarized English translation.
If converted to Islam, Four (4) copies of Certificate of Conversion to Islam and annotated Birth Certificate from PSA
If divorced, Four (4) copies of Divorce Decree/Annulment Decree/Death Certificate of previous spouse;
Four (4) copies of passport/s of the Filipino party/parties;
Four (4) copies of passport / Identification Certificate of the foreign spouse, if one of the contracting parties is a foreign national;
Two (2) recent colored passport size photographs (1.77”x1.37”) of both contracting parties;
Four (4) copies of Legal Capacity to Contract Marriage (LCCM) issued to the Filipino national prior to marriage (if available);
Four (4) copies of Original Affidavit of Delayed Registration of Report of Marriage will be required if the marriage occurred more than a year already;

REQUIREMENTS FOR FILIPINO APPLICANT/S FOR THE ISSUANCE OF CERTIFICATE OF LEGAL CAPACITY TO CONTRACT MARRIAGE (CLCCM)

Filipinos who wish to contract marriage in Malaysia need to secure a document from the Embassy called a Certificate of Legal Capacity to Contract Marriage (CLCCM). CLCCM is a document issued to applicants who are both Filipinos who wish to get married in Malaysia or a Filipino who wish to marry a foreign national in Malaysia.

If the applicants are both Filipinos, their marriage can be solemnized at the Philippine Embassy, if desired.
To apply for CLCCM, PERSONAL APPEARANCE of both parties is a must and submit the following complete documents to the Philippine Embassy and original documents must be presented.

For the Filipino applicant/s:

Original DFA-Authenticated Certificate of No Marriage (CENOMAR) issued by the PSA/NSO and I set of photocopy/xerox – please note that the CENOMAR is valid for six(6) months only from the date of issuance by the PSA;
Original DFA-Authenticated Birth Certificate issued by the PSA/NSO and one (1) set of photocopy/xerox;

For Muslim applicant already married – written consent of the first wife, notarized by a local lawyer/commissioner of oaths/justice of peace; kindly submit the oriinal copy
For divorced/annulled applicant (Malaysian) – JPN issued updated marriage record regarding divorce decree or annulment, authenticated by the Ministry of Foreign Affairs;

For divorced/annulled applicant (other nationalities) – Divorce/Annulment Decree (with "English translation"), authenticated by Ministry of Foreign Affairs and one(1) photocopy;
For divorced/annulled applicant (other nationalities) – Divorce/Annulment Decree (with English translation if applicable) authenticated by their respective Embassies/Consulate and one(1) photocopy.
For widowed applicant (Malaysian/other nationalities) – Authenticated JPN issued Death Certificate of spouse authenticated by the Ministry of Foreign Affairs / Death Certificate of spouse authenticated by their respective Embassies/Consulate and one(1) photocopy.

Copy of passport or old ID of the deceased; Copy of latest visa of the deceased (if applicable);
Clear copy of PSA/JPN Birth Certificate/Report of Birth of the deceased;
Clear copy of PSA/JPN Marriage certificate of the deceased (if applicable);
Copy of valid government ID of the nearest of kin / informant / undertaker (one who will file for the ROD as informant);
Police report issued where the death incurred; and,
Other documents available pertinent to the death of the deceased.
